I agree with the city. The law applies only to apartment buildings. I don`t want to be sitting at home smelling some fucker`s 2-pack a day habit.

i agree with her personally, but i understand the city`s argument. The only flaw in her logic is that she says there is something in the constitution to guarantee her happiness or something.. that`s wrong she has the right to PURSUE her happiness. That doesn`t guarantee it.

I`m a smoker and yes I`m irritated that nonsmokers think they are better than us and are trying to take our rights away. But in restaurants and such I can understand so I don`t complain. Bars on the other hand piss me off.If you go to the bar you should expect smoke and alcohol.

Besides what right does the government have to dictate business policy to a privately owned business. (refering more to the mom and pop places several have closed around here due to the smoking ban b.s.)

you would think something like that would be left up to the building owner. Most buildings I know are smoke free simply due to the amount of smoke damage that occurs from smoking in an apartment suite. Plus, a non smoker wouldn`t want to rent an apartment that smells like cigarettes, would they now. But if a building owner wanted to have a smokers area, or set of suites, that should be up to them, provided they can isolate the smell from the rest of the tenants.

Are you nuts? The smoke coming off the end of a cigarette is the same smoke being inhaled by the smoker, and containes all the harmful compounds inherant to tobacco smoke. Granted, the smoke exhaled by the smoker is marginally less hermful, as some of the chemicals have been absorbed by the smokers` lungs, but `second hand smoke` isn`t limited to exaled smoke.
How many children, (including my own, I`m ashamed to say) have developed respiratory diffulties as a direct result of being exposed to cigarette smoke?

Vizreel: Second hand smoking is a very real thing. Sure it`s not as bad as actually smoking and the negative effects can take decades to actually show(just like with normal smoking), but if you`re near a people who are smoking you`re going to get particles of tar and various kinds of carcinogens into your lungs.

HOWEVER.

Since I`ve yet to see smoke which can pass through solid walls, this law is pretty pointless. Unless you keep a steady tobacco fire up all the time in your apartment, smoking inside your apartment will not effect the other apartents.

In a way it`s okay to ban smoking in appartments, as long as it doesn`t go into private homes, but they didn`t have to make it a law...

The rule should be at the land owner, not the city!

Here in Denmark some new appartments have made non smoking rules, which is sufficient.

Landlords can choose tenants, tenants can choose apartment according to its conditions. If the law starts to give executive power on one side over virtue and not punish serious disturbance, it would always favour the complainers. Say what if my neighbour is too fat and make me look bad whenever he goes out the door. Should I have absolute power to make him go to the gym? No? but it`s good for him.

i think the real tragedy here is that people need to be forced to respect their neighbours and others.
"overwhelming evidence shows that second-hand smoking is dangerous", then "this idea that i am killing other people is ridiculous, prove it". i think this shows the lack of a thought process a lot of people have these days, the `i say it`s ridiculous therefore there is no evidence, overwhelming or otherwise`. reminds me of the bible bangers with their `the bible has never been proven wrong` bs.

on the core issue though personally i think someone`s right to smoke shouldn`t be infringed, and neither should someone`s right to breathe fresh air. if some kind of field which stops smoke moving from smokers to where non-smokers are was invented it would be great, but until then unfortunately laws like this are necessary to protect people`s rights.

There is scientific evidence that suggests second hand smoke might be harmfull, and rightefully so. But its far from beeing overwhelming, in fact its closer to thin than overwhelming.
