and yeah, they are doing him a favor by knocking it down to 17K. they have every legal right under the sun to charge him what he signed up for.

$17K probably was their "cost"... they still have to pay out their service fees to the Mexican service provider. That`s what they`re being billed by the Mexicans as part of their roaming contract.

Technically, you can download anything from the internet but you have to delete it within the 24 hours if you want to use the "Oh, I didn`t know what I was downloading was illegal so I deleted it" excuse.

In the court, the MPAA has to prove that you were fully conscious about the law of copyright infrigement that you were going to commit BEFORE the act and not WHILE in the act, to be able to fully accuse you and fine you apropriately.

It`s the same thing when accusing someone of voluntary homicide and involuntary homicide. The law has different levels of punishment between both infrigement of the law.

But then again, the law is case by case. So, the best way to avoid it is by not doing it. Besides, most movies suck so bad it`s only worth as a rental...

Edit: I thought about this just recently...
You download the movie X-men (for example) and the MPAA catches you and they fine you for piracy. But, then you go and buy the movie X-men (legally, of course), the same one you downloaded. Can you use the "it was a back-up excuse"?

your statements regarding the MPAA`s legal restrictions i belive are incorrect. i highly doubt many of the people who have been fined my the MPAA or agreed on out of court settlements knew the law precisely and still broke it.

and i dont think the back up excuse is valid. you have the physical disk, you could have copied that.
