Woman Motorist Failed Driving Test For S...

A woman who splashed a pedestrian as she drove through a puddle failed her driving test because the incident was technically classed as a crash.

Michelle Kelly, 31, was passing a bus stop when she drove through the water, spraying a man who was standing there.

At the end of the test, the mother-of-two said she was told by her examiner that she had failed because she should have stopped and exchanged details with man, as her actions constituted an accident.

Mrs Kelly, who works for a funeral director, described the decision as "ludicrous" after failing in Blackley, Manchester.

"It was my third test and I was really confident," she said. "To fail for something like that really annoyed me.

"It's ridiculous. Why should you hand over your details? What good would that do? It wasn't as though I'd deluged this pedestrian and if I'd swerved to avoid the puddle I might have caused an accident."

Mrs Kelly said she had no idea that splashing someone could lead to failing her test.

"I spoke to a firm of driving instructors with over 60 years experience and they had never heard of it. I didn't do it on purpose and didn't really think that much of it at the time but the examiner said it was a fault.

"Apparently it constituted a traffic offence and he was treating it as a road accident. He said I should have pulled over and exchanged details with the pedestrian."

Although the Highway Code does not directly mention splashing, it refers several times to the consideration of "all road users" and recommends that motorists "take extra care around pedestrians" in wet weather.

Robin Cummins, road safety consultant for BSM, said in some circumstances splashing someone could lead to a fine.

"Splashing someone is not classed as an accident, but would be classed as a serious fault," he said.

"You have got to look at how it was done. If someone drives straight through a puddle without due care and attention, they may be prosecuted.

"People have been fined for similar incidents in the past, but it is very rare. Because of the weather we have had recently, you can see why it may come to light."

Andrew Howard, head of road safety for the AA, said at first glance Mrs Kelly's failure seemed absurd, but on reflection he could understand the decision.

"It is a difficult one," he said. "I don't think the average motorist would think about it under the circumstances, particularly if you are left with little option but to drive through the puddle, given Britain's crowded roads.

"The Highway Code says if you are involved in a collision which causes damage or injury to another person you must stop. But is hitting a puddle a collision? What damage was done to the other person and where do you draw the line?

"Don't ask me what I would have done, but probably say sorry under my breath and carried on - many people have splashed me over the years."

Mrs Kelly said she estimated that she would have to spend a further £200 to cover the cost of a fourth test.

"Then it's nearly £60 for the test, £40 to use the car for the test and I'll have to have more lessons in the meantime," she said. "I'll have to wait until I get paid again."

A spokesman for the Driving Standards Agency said the incident was being looked into.

In Canada we have 3 levels of licences
L: Take a mutliple choice test (If you fail this, you fail at life), you can now drive but only with an adult in the car with you. 1 year before you can take your N
N: Driving test (Have marks deducted for things like not shoulder checking, etc) about 40% of people fail this once or twice. With an N you can only have 1 person + family in the car with you.

If you manage to not get any serious traffic violations after 2 years you get your full licence.

Ours is a little over the top, way too much regulation. But I can certainly see someone failing the driving test.

Fuck that, If you`re dumb enough to stand by a road with a huge fucking puddle you`re fair game. I`ve had my fair share of soakings walking home pissed or stoned or even tripping my tits off. I`ve also soaked a good few people myself. Heh, One time, near the sea front where I live started to flood, I could see down the road the water level was coming up over peoples headlights, some people had stalled and couldn`t start their engines again. But in the distance was a group of people (charva dickheads actually, so not people) were legging it to get out of this flash flood. So I tooled my car towards them, just where the water was getting really deep, 2nd gear, screaming revs, BANG, it felt like I`d hit a brick wall, but I kept the power up and got through. I swear I created my own little tsunami that propperly ruined those fuckers day. In heindsight it was dangerous, but boy was it a big wave, a proud moment. So, to the point, what would the filth have done if they saw me do that? Fuck em.

You have to take into consideration that a driving test in the UK will not be the same as in america. Im about to take mine for the first time on saturday and they have some pretty stupid ways that you can fail. Bumping into the kerb while reversing, for instance, can mean you fail the test. Or, apparently, splashing someone with a puddle. And apart from all the stupid ways you can fail, theres a lot of pressure too. It costs about a hundered pounds to take a test in this country now and theres about a 6 week wait to book a new one. I think this woman deserves a break.

@Kanthalas: Pretty much exactly the same here in Australia. My friend failed her first crack at her Ps (or `N` licence to Canadians) because she didn`t wait long enough (3 seconds) at a Stop sign. I failed my first attempt as well because at one intersection I didn`t check my rear-view mirror before breaking, then after reverse-parallel parking I didn`t leave my indicator on for 5 seconds before pulling out (onto a completely clear, quiet street after I had checked my mirrors, head-checked, and indicated may I add...). If my driving instructor wasn`t with me I would`ve gone ape-shit at that whore tester. Flawless 2nd time though, because the tester I had that day wasn`t raggin. Americans sound like you have it pretty easy. Instant fail for crap here, like what MarkII said- touching the curb, stopping over the white line at a red light, my bullshit reasons for failing, etc. It`s just a revenue raiser here

Considering how some jokers drive on the road, I happy with the tough driving test over here.
