I think he did the right thing. My only question is why didn`t he put his gun away. I know he has a permit, but you have to be a 1000 ft. from the school. It would have made the case a lot more cut and dry, if he had just put his gun in his car.

Turn off the Law and Order for 2 seconds.
This is a common misconception.
Just because an officer cuffs you, tells you sit on the curb during a traffic stop or takes you into custody -- this does not mean they have to read you Miranda.

Miranda is read before officials are allowed to *ask you questions* pertaining to the possible crime.

There is a huge, HUGE difference between being arrested and being questioned.

I LOVE when people spout off about this issue before fully knowing the justice system. It`s sad that people aren`t informed and yet have the nerve to bitch about their "rights."
Educate yourself first. It does wonders, 4serious.

^cuffing someone IS arresting someone on legal terms
and you are obliged to say his rights out loud and tell him what he`s being arrested for...

if the cops ask him to be interrogated, then the individual has a right to decline (but in some cases where they need your justified witness) you have a right to have a lawyer during interrogation.

I just love when people play cops without the proper know how. Educate yourself first. It does wonders.

That fat cop is fucked but publishing the video through the internet is a stupid move...

You can arrest someone without the intention of interogating him.

He was charged with misdemeanors so there would be no interrogation. If they needed to ask him questions, they would read him his rights in the station.

Miranda rights pertain to the interrogation of a suspect not to the detainment of one.

The court session would not require a evidence in the way a murder or rape trial would. It would simply be the police officers word against his based on the reports of the 4 officers.

In this case, they probably took him to the station, booked him, sent him to court house asap and he was out on bail.

*Restraining freedom of movement w/restraints or hands doesn`t mean someone is under arrest. If you cuff a guy and ask him to sit on the curb when he allowed you to do a search of his car, it ISN`T an arrest. Same as when you tell some crazy bitch to go sit in the cop car for a few while you ask her crackhead husband why he called 911.

*Advising a suspect of his rights isn`t legally required during an arrest period. Only when they`re asked questions to prevent self incrimination.

What you are right about is that officers need to tell the suspect why they`re arresting him. Some don`t though and simply repeat Miranda because they don`t feel like explaining anything.

^ A police state Ibanez. If you get involved in a situation like this, fight back. The courts will eventually rule in your favor. You`ll have to go through the system though, and with a few bruises to boot, but in the end, you`ll be vindicated and will soon have lumps of cash to show the cops who falsely imprisoned you. I`m super serial.
