a 49-year-old quadriplegic who says his life is a "living hell" will find out whether he can starve himself to death as early as next friday.

lawyer john hammond requested wa supreme court chief justice wayne martin hold a bedside hearing next friday for his perth client, christian rossiter, 49, at the nursing home where he's in care.

the brightwater care group has lodged an application seeking advice on whether the nursing home should continue feeding mr rossiter, despite his wish to starve to death.

mr rossiter has described his situation in total paralysis as unbearable. he is in 24-hour care at brightwater, in perth's northern suburbs.

he first publicly declared his wish to die in june, and has since had discussions with right-to-die advocate philip nitschke and mr hammond about possible options for ending for his life.

speaking through a tracheotomy tube, mr rossiter said he wasn't afraid of dying, just the pain.

mr rossiter yesterday told perth now that australia should adopt switzerland's euthanasia laws and allow people freedom of choice in their right to live or die.

"i'm hoping the courts won't force them (nursing home staff) to sustain me," mr rossiter said.

"this is living hell.

"i used to be a cyclist, i used to be a keen walker.

"i bushwalked around the world ... i've rock climbed in yosemite valley in california up very steep cliffs.

"i've got a degree in economics and now i can't even read a newspaper, i can't turn the pages.

"i want to have the food withdrawn."

mr hammond said his client's wishes should be respected.

"he wants to die now, not tomorrow, not next week, but he wants to die now and he wants to die without pain," mr hammond said yesterday.

"i think if we are to be civilized in the way we deal with people like mr rossiter then his wish should be granted."

in court today, mr hammond said his client would like the opportunity to defend his case in person because the impact of his evidence would be lost in court documents.

transporting mr rossiter to court would be difficult and cause him physical pain, so a bedside hearing would be preferable, mr hammond said.

chief justice martin said he would consider the request, but that a written statement might be sufficient.

mr rossiter said he hoped the court would look at his case compassionately.

a court date for the case has been set for next friday.

mr nitschke said mr rossiter's case had attracted international interest.

he said an asian media group had offered to set up a 24-hour webcam so people around the world could monitor mr rossiter and his plight.

her emaciated body was found only when a housing official called at the one-bedroom council bungalow in warrington, cheshire, to check why she had not paid rent for six months.

care workers visited until april, but then she started to refuse help, the newspaper said.

two months later, she was admitted to hospital suffering malnutrition but apparently discharged herself without her family being informed.

the royal mail returned the benefits book and cheques to the pensions office after the front door was replaced and they were unable to deliver post.

but officials there reportedly failed to alert family or social workers that ivy had no income.

ivy's daughter sandra murphy, 42, told the mirror: "mum was always independent and social services were meant to be keeping an eye on her. they weren't.

"if we'd known her benefits were cut and the care visits had stopped, we would have been round there in a flash.''

warrington borough council said it had tried to put a letterbox on ivy's door but were not given access to carry out the work.

"people have a right to refuse help. while they are capable of making that decision, we are powerless to intervene,'' a spokeswoman told the paper.

the department of work and pensions is to launch an inquiry into the incident.

three mexicans who survived for nine months as their small fishing boat drifted across the pacific ocean tossed two other men overboard after they died of starvation during the journey, officials said on thursday.

the three were rescued last week by a trawler more than 5,000 miles from mexico's pacific coast fishing village of san blas, where they left for what was supposed to be a routine shark fishing trip last november.

stranded on the high seas for nine months, they stayed alive by eating raw birds and fish and drinking rain water, but the government said on thursday that two other men perished during the ordeal and were thrown overboard.

"at the start of this fishing trip, there were five people on board the boat. two of them would have died shortly afterward," miguel gutierrez, a senior official at mexico's foreign ministry, told reporters.

"they refused to eat, and that's why they died," he said, and rejected suggestions that the survivors may have eaten the bodies of their dead companions.

the story has captivated mexico but the survivors did not mention their dead companions when they were interviewed on wednesday by radio and television stations from the boat that rescued them near the marshall islands.

gutierrez said a survivor told a government official that one man died in january and the other in early february.

"it is natural that people who have spent nine months on the high seas, in the conditions they survived, would not have their complete story straight away," said foreign minister luis ernesto derbez.

a local government official in san blas said on thursday that no one there knew two other men were on board the very basic 25-foot (8-meter) fiberglass boat.

the survivors' families had given them up for dead, and were astonished to learn from news reports that they survived.

"now you see that miracles exist," said marina estrada, the aunt of one of the fishermen.

the three men were skinny and sunburned after their ordeal but are otherwise in good health.

the taiwanese fishing trawler that found them is expected to return to port in the marshall islands next monday. the survivors will then be given medical checks and flown home.

' a toddler whose remains were found inside a suitcase was starved to death by religious cult members - including his mother - because he refused to say 'amen' after meals, police said today.

ria ramkissoon and three other members of the group have been charged with the first-degree murder of her son javon thompson, whose body was found in april.

u.s. police and the family of ramkissoon say that the group, based in baltimore and called 1 mind ministries, is a cult.

javon's food was stopped in december 2006 - when he was about 15 months old - partly because he refused to say 'amen' after dinner, investigators were told by two children who had been taken away from the cult by philadelphia police.

members viewed javon as 'a demon', the children said.

no medical care was sought for the toddler when he stopped breathing, and he died in his mother's arms, according to court records of police interviews with the two children and another informant.

the anonymous informant told police that cult member queen antoinette then left the boy's body in a room for more than a week, claiming 'god was going to raise javon from the dead,' court documents show.

afterwards, antoinette burned the clothing and mattress and placed his body in a green suitcase, which she would periodically open and spray with disinfectant to mask the stench, police say.

the group members allegedly left baltimore early last year for philadelphia, stowing the green suitcase and other luggage in a shed belonging to a man they had befriended.

officers found the suitcase, containing the remains of a small child, in april after a tip-off. they are now waiting for dna tests to confirm the boy's identity.

ramkissoon, 21, was awaiting a bail review today while being held in custody in a psychiatric ward.

the three other people charged over javon's death - antoinette, 40, also known as toni ellsberry or toni sloan; marcus cobbs, 21; and trevia williams, who turns 21 on tuesday - are already in custody.

they were arrested in may in new york on warrants charging them with failure to appear in court after a scuffle with police in a child custody dispute.

a fifth alleged cult member, steven bynum, has also been charged with first-degree murder but remains at large, police say. he is believed to be in new york.

ramkissoon's family said she should not be held responsible for her son's death.

'she had no control over that situation at all,' said her stepfather craig newton.

her mother seeta khadan-newton says ramkissoon was not behind the decision to stop feeding the boy.

'my daughter was a victim, just like my grandson,' ms khadan-newton said.

'somebody made that decision to not feed that child, and my daughter had to follow instructions.'

according to court documents, ramkissoon joined 1 mind ministries after javon was born.

ms khadan-newton last saw her in april 2006; she later sued for custody of her grandson, writing in a letter to a judge that 'the cult leaders' were preventing her from contacting her daughter.
