the posse members, deputies and trained volunteers, are making use of a smuggling law implemented last year, to arrest not only the smugglers, but also those being smuggled across the borders.
the law, which made smuggling a state crime in arizona, allows local law enforcement to arrest smugglers. now, the law has been applied to those being smuggled, who are charged with conspiracy to smuggle.
instead of being turned over to federal authorities, illegal immigrants will be incarcerated. sheriff arpaio said in the washington times that he feels he is sending a message to those wanting to cross the border illegally, namely that they don’t get a free ride back to mexico, but will end up in jail.
the sheriff has been accused of racial profiling by representatives of the incarcerated immigrants. so far, about 100 illegal immigrants face a maximum of 2 years imprisonment.
next week, maricopa superior court judge thomas o'toole will hear a motion filed by los angeles lawyer peter a. schey, retained by the mexican consulate in phoenix. the motion states that the county does not have the authority to arrest illegal immigrants, and that all charges should be dropped.
sheriff arpaio stated that the mexican government is interfering with arizona laws, and that the effort by schey to get the charges dropped should be thwarted,
over half a million illegal immigrants were caught crossing the border by the u.s. border patrol in arizona last year.
