portland, ore. - a portland man who attacked his ex-girlfriend and impaled her pet fish this summer has been sentenced to two years probation, a psychological evaluation and community service. donald earl fite iii, 27, pleaded guilty tuesday to animal abuse and domestic violence assault. according to court records, sarah harris had broken up with fite but returned to her portland apartment july 25 to find him lying on her bed, saying he wanted to get back together. when harris tried to leave, fite shoved her against a wall, grabbed her hair and tossed her against a bathtub. harris fled but returned with an officer to find her fish — a bright purple betta named “delorean” — on the wood floor with a knife through it. according to court records, fite quickly admitted killing the fish, telling police: “if she can't have me, then she can't have the fish.” fite's attorney, tom macnair, said tuesday that killing the fish was a “very low point” in his client's life. “he is absolutely mortified and ashamed about what he did to the fish,” macnair said in multnomah county circuit court. fite, who had no previous criminal history, declined to make a statement. harris did not attend the hearing. in a phone interview with the oregonian newspaper, she recalled crying hysterically when she saw the fish with a knife sticking through it. “donald bought the fish for me, and i'm sure he knew how much i cared for it,” she said. betta fish, also known as siamese fighting fish, are colorful freshwater aquarium fish that usually are between 2 and 3 inches long. prosecutor eric zimmerman told judge eric bergstrom that harris plans to get a memorial tattoo of the fish and wanted fite to pay for it. bergstrom, however, declined to make fite pay restitution for the tattoo. the judge ordered fite to stay away from harris, but said he could have contact with fish. source
judge gives man probation in a case that involved an assault with pickles. talk about being in a pickle: a judge gave a 35-year-old man probation in a case that police said involved an assault with pickles. according to police reports, the pickle problems began when bobby lee bolen of buchanan was hanging out at his then-friend jody lee's home in buchanan on aug. 20. bolen went to the refrigerator and helped himself to some pickles. according to the report, lee told bolen he couldn't afford to feed everyone and not to eat his pickles. bolen then began yelling and swearing and stormed out, according to the report. later, bolen barged back into the house and got into an argument with lee. lee told police bolen slammed him down on the couch and threw two large pickles at him and said, "here's your damn pickles." bolen also shoved former friend j.w. romanski iii and beat lee with a telephone when he tried to call 911, according to the report. two counts involving bolen's assaults were dismissed as was a charge of cutting or interfering with phone lines. "if this is not the silliest case i've ever seen in this courtroom, it certainly is in the top 10," berrien trial court judge scott schofield said. "the fact that it's silly doesn't mean that it's not serious." defense attorney robert lutz said alcohol appeared to be at the root of bolen's problems. bolen's sentence included 54 days in jail with credit for 54 days served and one year of probation. source
scotland- a man caught trying to have sex with his bicycle has been sentenced to three years on probation. robert stewart, 51, admitted a sexually aggravated breach of the peace by conducting himself in a disorderly manner and simulating sex. sheriff colin miller also placed stewart on the sex offenders register for three years. mr stewart was caught in the act with his bicycle by cleaners in his bedroom at the aberley house hostel in ayr. gail davidson, prosecuting, told ayr sheriff court: "they knocked on the door several times and there was no reply. "they used a master key to unlock the door and they then observed the accused wearing only a white t-shirt, naked from the waist down. "the accused was holding the bike and moving his hips back and forth as if to simulate sex." both cleaners, who were "extremely shocked", told the hostel manager who called police. sheriff colin miller told stewart: "in almost four decades in the law i thought i had come across every perversion known to mankind, but this is a new one on me. i have never heard of a 'cycle-sexualist'." stewart had denied the offence, claiming it was caused by a misunderstanding after he had too much to drink. the bachelor had been living in the hostel since october 2006. source i think being on a sex offender list for three years is a bit much.
boston - the winner of a $1 million lottery scratch ticket may not be so lucky after all: he's a convicted bank robber who isn't supposed to gamble. timothy elliott faces a dec. 7 court hearing over whether he violated his probation when he bought the $10 ticket for the $800 million spectacular game at a supermarket in hyannis. elliott was placed on five years' probation after pleading guilty in october 2006 to unarmed robbery for a january 2006 heist at a bank on cape cod. under terms of his probation, he "may not gamble, purchase lottery tickets or visit an establishment where gaming is conducted, including restaurants where keno may be played." elliott, 55, has collected the first of 20 annual $50,000 checks from the massachusetts lottery commission. a picture of elliott, holding his first check, was posted on the lottery's web site monday, though it was removed by wednesday. as part of his sentence, elliott was put under the care of the state mental health department and sent to a hospital for treatment, and state officials refused wednesday to say whether he was still being treated. a telephone number for elliott could not immediately be located wednesday, and it was not clear whether he had a lawyer. the lottery routinely cross references the names of winners with the state revenue department to see if they owe back taxes or child support, lottery spokesman dan rosenfeld said. in those cases, winnings go straight to the revenue department. but in this case, it will be up to the court to determine what will happen with elliott's winnings.
