the european union fined microsoft corp. €280.5 million ($405.6 million) wednesday for defying a 2004 anti-trust ruling, and warned the company to comply or face bigger fines next month. "the eu commission cannot allow such illegal conduct to continue indefinitely," said eu competition commissioner neelie kroes. "no company is above the law. each and every company, large or small, operating in the eu must abide by eu law." microsoft shares fell 46 cents us on nasdaq wednesday to close at $22.64 us on a volume of 77.1 million shares. the penalty comes on top of a record €497 million ($718.6 million) fine the commission imposed on microsoft in march 2004 in a precedent-setting anti-trust case. at the time, the eu ruled that microsoft had tried to cripple its competitors in order to win control of the european market for computer software. microsoft said it would appeal the latest fine. "we do not believe that any fine, let alone a fine of this magnitude, is appropriate given the lack of clarity in the commission's original decision," microsoft lawyer brad smith told reuters in a conference call. smith said microsoft remains totally committed to full compliance with the commission's 2004 decision. in 2004, the eu ordered microsoft to share program code with its rivals after it ruled the software giant had abused the dominance of its windows operating system to squeeze out competitors. it ordered microsoft to supply "complete and accurate" technical information to developers to help them make software that will work with its windows operating system. microsoft said it only fully understood the eu's demands when it talked with an independent monitor this spring. microsoft now has a team of 300 people working full-time on the eu's requests, and six of the seven instalments have been delivered. additional fines at this stage would be "unjustified and unnecessary," microsoft said. kroes said she levied the new fine because microsoft had ignored the eu's previous anti-trust rulings. "microsoft did not even come close to providing adequate information," kroes said. "i regret that, more than two years after the decision … microsoft has still not put an end to its illegal conduct." instead of complying with the court order, she said microsoft had used virtually every available legal and court procedure to drag out the process. the eu has also warned microsoft to avoid anti-trust problems with its new operating system, vista, which includes an internet search and a pdf-type document reader that could pose problems for current rivals. source

martinsburg, w.va. — a man who made more than 600 telephone calls to a shoe store and other businesses to ask women about their shoes and feet must pay a $200 fine. james lee fink, 31, placed 119 calls from his cell phone to the chambersburg (pa.) mall, 513 calls to a holiday inn in havelock, n.c., and 17 calls to a comfort inn in chambersburg between jan. 1 and may 8, 2006, pennsylvania state police trooper jeff bopp said thursday. the caller would ask the women what kind of shoes they were wearing and whether they would show him their feet if he came into their store. the man identified himself as brian thompson, but state police used phone records to link the telephone number to fink, whose last known address was in martinsburg. fink pleaded guilty to harassment in august in franklin county court in pennsylvania. he was sentenced wednesday. in addition to a fine, franklin county court judge john walker ordered fink to serve a year on probation. fink also was ordered to stay away from the shoe department in frederick, md., and one woman whom he continuously harassed. source: foxnews
a turkish court fined 20 people for using the letters q and w on placards at a kurdish new year celebration, under a law banning characters not used in the turkish alphabet, rights campaigners said tuesday.
the court in the southeastern city of siirt fined each of the 20 people 100 new lira for holding up the placards, written in kurdish, at the event last year. the letters q and w do not exist in the turkish alphabet, but are used in kurdish.
under pressure from the european union, turkey lifted bans on teaching and broadcasting in kurdish in 2002, but bureaucratic resistance has delayed implementing the reforms.
state television and radio began limited broadcasts in kurdish last year, but local television channels have yet to receive permission to start programs in kurdish.
the 1928 law on the adoption and application of turkish letters changed the turkish alphabet from the arabic script to a modified latin script and required all signs, advertising, newspapers and official documents to only use turkish letters.
many shops and companies in turkey have names, signs and advertising using the letters q, w and x which are not used in turkish, in apparent violation of the 1928 law, but have not been prosecuted.
more than 30,000 people have been killed, most of them kurds, since the kurdistan workers party (pkk) rebels began an armed campaign for kurdish self-rule in the mainly kurdish southeast of turkey.

new york -- the sacramento kings were fined $30,000 by the nba on monday for showing derogatory images of detroit on video screens prior to their home opener against the pistons.
when the pistons were introduced nov. 8, the arco arena scoreboard flashed pictures of abandoned buildings, burned-out cars, piles of rubble and other negative images of detroit. the pistons won the game 102-88.
the kings apologized that night and owners joe and gavin maloof bought full-page ads that ran in the detroit news and detroit free press, expressing "great respect for detroit's long and rich tradition as a landmark american city and the incredibly positive impact the motor city has made over the course of our country's history."

a south dakota man has been fined and sentenced to probation for sending a letter containing animal feces to a local government office. jeffrey dezeeuw pleaded guilty in a sioux falls federal court to one count of mailing injurious articles. the 45-year-old man smeared excrement on a traffic citation, a note and cash before sending it to the minnehaha county cerk of courts last july. dezeeuw faces three years of probation and a $500 fine. it was not clear what kind of animal feces was used. source, source
cbs corp. asked an appeals court on friday to overturn a federal communications commission fine for the network's broadcast of pop singer janet jackson's breast flash during the 2004 super bowl.
the fcc ruled that the incident was legally indecent and fined 20 stations owned by cbs $550,000.
"we disagree strongly with the fcc's conclusions and will continue to pursue all remedies necessary to affirm our legal rights. cbs has apologized to the american people for the inappropriate and unexpected half-time incident, and immediately implemented safeguards that have governed similar broadcasts ever since," the network said.
last month, the one and only president george w. bush signed a new law that raises fines tenfold for radio and television broadcasters that air extensive profanity or sexual content that the fcc determines violate u.s. decency standards.

congress approved the increase in fines -- to as much as $325,000 per violation -- in response to the super bowl incident. cbs said it was required to pay the $550,000 fine as a procedural step in order to appeal the ruling.
u.s. television and radio broadcasters are barred from airing obscene material and are limited from broadcasting indecent materials between the hours of 6 a.m. and 10 p.m., a period of time when children are "likely" to be watching. the restrictions do not apply to cable or satellite services.

illinois woman fined $25 for having plantes made from old toilets in her front yard. the planters in her front yard brought tina asmus national publicity last month. this week, they brought her a $25 fine. asmus said tuesday she will go to court to fight to keep her lawn ornaments, which are made from two old toilets and a bathroom sink. lakemoor police chief rick iverson said asmus was issued the $25 noncompliance ticket monday after a 30-day warning ticket expired. ivarson said the village is not singling asmus out, since it has issued about 100 notices of violation of the same ordinance, and the majority of those cited have complied. the ordinance violations cited by police range from grass that is too long to junk in front yards. source have any interesting articles you'd like to share? article request thread.
manchester city council spent £3,000 on prosecuting elavi dowie, 31, for twice breaching a 19th century law on street trading. the law allows traders to spend up to 20 minutes on the city's market street. but cctv footage proved that on one occasion mr dowie was hawking cds of his music for 35 minutes, while on another he stood at the same spot for several hours. local magistrates found him guilty of two counts of illegal street trading and ordered him to pay fines and costs totalling £330. mr dowie, a dance musician, described the decision to prosecute him as "ridiculous". he said after the case: "i was basically going up to people in the street and explaining to them about my music. the cd only cost £1 and people were willing to buy it. "there have never been any complaints. it seems ridiculous when there's a recession to clamp down on someone who is trying to start a business." manchester city council denies that its licensing officers had been heavy-handed. a spokesman said: "the council enterprise and protects consumers. mr dowie's activities were illegal and we have a duty to protect consumers, particularly during the current economic climate. "consumers who buy products from illegal street traders are unlikely to get their money back if they make a complaint." source
extreme disciplinary action part of taxi & limousine commission's new approach to curbing driver rudeness new york (cbs) ? there are about 45,000 cab drivers on the streets of new york city, but it's those rude few that make a very lasting impression. one driver was recently fined $1,000 and suspended for cursing. cbs 2 hd has learned the details on what's being done to make sure your next ride is a pleasant one. getting a cab ride in gotham can be interesting to say the least. just ask its residents. "i think they drive like maniacs," said irene bremis of greenwich village. "more than once i feel like i have almost died because the driver is like, 'blah, blah, blah …'" jackson heights resident carolyn kaylor said. "they come off with a real harsh attitude and you're like let me just get to my location and leave," canarsie's jean pyronneau said. some of the more popular passenger gripes include drivers talking on the phone, not speaking english, not knowing their way around, and also giving passengers a hard time when they want to pay by credit card. the taxi & limousine commission receives about 20,000 complaints per year and 20 percent of them are about driver rudeness. "it's a negative reflection on our city when drivers, even when they are stressed out, (are) showing that stress in a very concrete way to visitors and tourists, " said tlc chairman matthew daus. when cabbie zbigniew sobczak got into a verbal altercation with another driver and said the "f" word, he was fined a grand and suspended for 30 days, even though neither cabbie had a passenger at the time. "he curse me. i put a couple of words to him, but … that's it," sobczak said. "we not beating each other." fair or not, the tlc says the punishment sends the message to drivers that they need to mind their manners. "we need them to bite their tongue, basically represent the image of the city that it is now," daus said. cbs 2 hd went along with the tlc's undercover inspectors recently as they looked for violators. they've been taking covert rides since january. if you have had a bad experience or had to put up with a rude driver, go to the tlc web site or call 311. the tlc plans to bring administrative charges against the other cab driver involved in the verbal altercation with sobczak, because of his use of inappropriate language as well. source
