a county courthouse in arkansas was evacuated last week after officials said they found a possible explosive device -- one brought in by an attorney.

officials said the item brought into the carroll county courthouse in berryville was an undetonated firecracker that cindy baker intended to enter as evidence in a trial.

sheriff chuck medford said a member of the springdale bomb squad happened to be in the courtroom. the officer viewed the device and ordered an evacuation. subsequently, the entire springdale bomb squad was called to detonate the possible explosive object.

medford said the device did not explode, and it appeared to be what he calls a "conventional explosive device."

pending an investigation, officials said, at this point, no charges have been filed against baker. atf agents are on their way to berryville to investigate the incident.

the movie studios may have discovered a new and powerful weapon in their war on copyright infringement.

the courts have for the first time found that the electronic trail briefly left in a computer server's ram, or random access memory, by each visitor to a site is "stored information" and must be turned over as evidence during litigation, according to cnet news.

jacqueline chooljian, a federal judge in the central district of california in los angeles, issued the decision while presiding over a court fight between the studios and torrentspy, the bittorrent search engine accused of copyright infringement in a lawsuit filed last year by the film industry. on may 29, chooljian ordered torrentspy to begin logging user activity, including ip addresses, and turn the data over to the motion picture association of america (mpaa).

the judge stayed the order on friday to allow torrentspy time to prepare an appeal, which must be filed by tuesday. she also allowed torrentspy to mask the internet protocol addresses of the site's users "at least at this juncture."

should chooljian's order stand, the decision could force web sites to rethink privacy precautions.

the electronic frontier foundation called the judge's decision "troubling" and said it could mean that any web site operator could be compelled to log user activity anytime they faced a lawsuit. in its privacy policy, torrentspy pledges not to collect any personal information about users except when they "specifically and knowingly provide such information."

but user data was stored at torrentspy, according to chooljian. the judge said in court documents that this information survived on torrentspy's server ram for about six hours. ram is defined by chooljian as "a chip where volatile internal memory is stored."

the judge agreed with the mpaa that the existence of user data in ram enabled torrentspy to retrieve user information. she also wrote that the data was crucial for getting at the truth in the case, according to records.

"there can be no serious dispute that the server log data in issue is extremely relevant," the judge said in her finding.

concealed evidence?
in one of the most hotly contested disputes so far in the case, the records show that the mpaa accused torrentspy of trying to conceal evidence when the search engine began directing visitors to the servers of an outside vendor.

the mpaa claimed that torrentspy did this to avoid being in possession of user information as the search engine anticipated receiving a court order, according to records. torrentspy denied the accusations and said that the outside vendor was chosen for "significantly faster processing and delivery."

among the arguments torrentspy made against turning over logs was that the law only required the company to produce documents already in possession. it did not ask for the creation of new records.

but that's exactly what the judge was asking the company to do, torrentspy's attorneys asserted in court records. chooljian disagreed.

"since the information is already in the ram, then defendants aren't really being asked to create new information," chooljian wrote.

she also noted that it was not her goal to set a far-reaching precedent with her decision.

"the court emphasizes that its ruling," chooljian said in the documents, "should not be read to require litigants in all cases to preserve and produce electronically stored information that is temporarily stored only in ram."

torrentspy's other arguments against tracking users were that the costs were too high and that the action would violate user's privacy and hinder free speech. all were rejected.

in response to torrentspy's free-speech argument, the judge cited other cases that had established illegal file sharing "qualifies for minimal first amendment protection."

should torrentspy lose in appeal, it would likely have seven days to produce data logs, according to the court records. the company's attorney, ira rothken, said friday that it is unlikely torrentspy would continue operations in the united states if forced to turn over user data.

clearwater, fla. (ap) — a former high-ranking scientology official who handled the case of a mentally ill member who died under church care ordered the destruction of incriminating evidence to cover up missteps, a newspaper reported monday.

the ex-official and church defector, marty rathbun, had for years insisted the church did nothing wrong in handling the case of lisa mcpherson's death on dec. 5, 1995. but he recently told the st. petersburg times the church botched the woman's case from the start.

the church dismisses rathbun as a bitter former member who inflated his importance. the church said he had been demoted in 2003; he left in 2004.

rathbun said he initially wanted to go to the state attorney's office after the 36-year-old's death, but he instead followed the church's culture to never admit fault. he and others removed papers from mcpherson's files, including a caretaker's opinion that the situation was out of control and the patient needed a doctor.

"i said, 'lose 'em,' and walked out of the room," rathbun told the newspaper.

mcpherson's death prompted investigations, lawsuits and has remained a talking point among scientology critics.

a wrongful death case was settled with mcpherson's family in 2004 under undisclosed terms. and while investigations brought charges of criminal neglect and practicing medicine without a license, they were later dropped when a coroner changed the cause of death to an accident from undetermined.

state attorney bernie mccabe said destruction of evidence charges would have had to be brought within three years of the crime and that the investigation into mcpherson's death was over.

"the whole thing was done wrong," rathbun told the newspaper. "i can't tell you what a technical crime this was."

church spokesman tommy davis said he couldn't specifically comment on many of rathbun's claims because of the settlement.

"what he's been saying — there's so many lies you can't believe anything at this point because he's been lying so much," davis said.

mcpherson joined scientology at 18 in her hometown of dallas and moved to the church's spiritual headquarters in clearwater.

on nov. 18, 1995, she was involved in a traffic accident and soon became frantic, according to the newspaper's report, stripping off her clothes and walking along the street. she was taken to the hospital, where doctors discussed having her committed for psychiatric evaluation. but scientology opposes psychiatry and psychiatric drugs.

according to the times, about 10 church members went to get her and she signed out against a doctor's advice. she was brought to the church's fort harrison hotel.

for 17 days, mcpherson was kept in a room where church officials tried to calm, feed and medicate her, keeping logs of what transpired.

she slapped and screamed at the caretakers, babbled and vomited, the newspaper reported. as she spiraled downward and lost about 12 pounds, a church doctor who was unlicensed in florida phoned david minkoff, a fellow scientologist who was a licensed doctor in the state. minkoff said mcpherson should be taken to a hospital down the street.

the scientologists feared mcpherson would be exposed to psychiatric care there and drove 45 minutes to a hospital where minkoff was working. minkoff pronounced her dead upon arrival.

other revelations in the newspaper's three-part series revealed that mcpherson had achieved "clear" status, a designation that means they are free of painful trauma and unwanted feelings, just weeks before her mental breakdown and death. the designation comes through auditing, scientology's trademark counseling sessions.

the newspaper earlier reported that the leader of the church of scientology, david miscavige, struck his subordinates numerous times. the church denied the allegations, saying they are lies in an effort to tarnish miscavige, who has led the church for more than two decades.

stone age humans could well have deserved the name. scientists have found the drug paraphernalia used by prehistoric humans to cook up herbal mixtures to get themselves high.

scientists have long suspected that humans have an ancient history of drug use but much of the evidence has been indirect, ranging from the bizarre images found in prehistoric cave art to the discovery of hemp seeds in excavations.

now, however, researchers have found equipment used to prepare hallucinogenic drugs for sniffing, and dated them back to south american tribes.

quetta kaye, of university college london, and scott fitz-patrick, an archeologist from north carolina state university, found the ceramic bowls, plus tubes used to inhale drug fumes or powders, on the caribbean island of carriacou.

the bowls appear to have originated in south america between 100bc and 400bc and were then carried the 400 miles to the islands. one implication is that drug use may have been widespread for thousands of years before this time.

kaye’s research, published in the journal of archaeological science, said: “the objects tested for this study are ceramic inhaling bowls that were likely used for the ingestion of hallucinogenic substances.”

the use of such paraphernalia for inhaling drugs is well-known but the age was a surprise. what is less clear is exactly which drugs would have been used. cannabis was not found in the caribbean then.

there were, however, alternatives. kaye believes one of the most likely was cohoba, a hallucinogen made from the beans of a mimosa species.

archeological investigations in mexico and texas have found indirect evidence that as far back as 5,000 years ago humans were extracting mind-expanding drugs from mescal beans and peyote cacti, while opiates can be obtained from species such as poppies.

fungi may also have been used. moulds, including the powerfully hallucinogenic ergot found on rotting vegetation, were common in caves. fungi like the fly agaric toadstool or psilocybin mushroom were also widespread.

richard davenport-hines, a former history lecturer at the london school of economics and author of the pursuit of oblivion, a global history of narcotics, believes humans have been using drugs for thousands of years.

“drug use became widespread in many early agriculture-based societies simply because it was the only way people could cope with spending long hours working in the fields, often in horrible conditions like baking sun,” he said.

many archeologists believe religion and spiritual beliefs must also have played a part, with drugs being used to induce spiritual or trance-like states.
