portland, oregon (reuters) - an oregon man has filed a $1.6 million "loss of companionship" claim against a neighbor who ran over his family's 13-year-old dog, grizz.

raymond weaver ran over the golden retriever and cocker spaniel mix in 2004 with a pick-up truck, forcing the owner, mark greenup, to have the animal euthanized, according to a lawsuit by greenup.

greenup, whose claim is usually reserved for the loss of a spouse, says the dog provided each member of his family with solace, affection, friendship, love and protection.

larry dawson, the driver's attorney, said the dog's injuries were not serious enough to require euthanasia and wants the court to dismiss the loss of companionship claim.

"i've owned dogs and i love them dearly," said dawson. "but they are by law personal property and you do not get noneconomic damages for personal property."

the case goes to trial on tuesday in clackamas county circuit court.

when the call came in at 6:22 p.m., deputy dustin mormando recognized the suspect's description. the deputy had been in the sandwich shop earlier that day and said young came in, filled a cup with ice and then lingered outside.

he recognized 56-year-old young from past experience as a transient who lived in the nearby woods. a clerk, jennifer grispo, told the deputy that young entered the store and approached the cash register where she was standing. "give me all of your money," he reportedly said. "don't try anything funny because i've got an excalibur."

grispo emptied $440 into a plastic subway bag and handed it over.

young allegedly told grispo and another clerk to walk with him out the back door and when they got outside, young bolted into the woods, a report shows.

the other clerk backed up grispo's account and added that she recognized young as the guy who had been coming in for ice the past few days. mormando reported that the suspect was casing the store.

a brooksville police employee, michael pizzino, was also in the area. he alerted a deputy that he had seen a suspicious man tuck a bag of money under his shirt and run into mariner lanes bowling alley. following that tip, two deputies searched the bowling alley and came across young sitting at the bar. a k-9 deputy and his police dog also conducted a search that led from the back door to the bowling alley.

the money was returned to subway and young was charged with unarmed robbery.

john agnesini, 26, a magazine designer, said he had already taken a few bites from the sandwich in late june when he spotted the knife jutting out from the bread's crust. the lawsuit, filed in manhattan state court, seeks $1 million.

"if i didn't look at it, i don't know what would have happened," said agnesini. "that's the last thing you think about a sandwich you eat all the time."

a colleague telephoned the chain to complain, but subway never apologized, he said.

subway spokesman kevin kane said in a statement the company was investigating.

"at subway restaurants, we take food safety and customer comments very seriously. we are aware of the complaint made and are investigating the facts alleged. as a pending legal matter, we cannot discuss this matter further," said kane.

the case was filed on public health grounds, but agnesini's lawyer, yetta kurland, also said she was looking into whether the june incident may have been intentional or malicious.

martin county sheriff's detectives said keith griffin, 48, of jensen beach, was charged wednesday with 10 counts of possession of child pornography stemming from the more than 1,000 images a detective found on his computer, tcpalm.com reported friday.

detectives said griffin told them he would commonly leave his computer on and his cat would download strange materials by walking on the keyboard. he was taken to the martin county jail in lieu of $250,000 bail.

a spokeswoman for victoria's secret, which is operated by limited brands inc, could not immediately be reached for comment.

scientists in south korea say they have successfully completed the world's first commercial cloning of a pet dog.

bernann mckinney, from the us state of california, stumped up $50,000 (£25,000) for five identical copies of booger, her beloved pit bull terrier.

the puppy clones were unveiled at a press conference in the south korean capital, seoul, on tuesday.

"booger was my partner and my friend," ms mckinney said, as she appeared with the five identical copies of her pet.

scientists at seoul national university created a number of embryos from preserved skin cells taken from booger's ear tissue before he died.

the embryos were then implanted into two surrogate mother dogs and, three months later, the puppies were born..

among the scientists involved in the project was professor lee byeong-chun, who was part of the team that created the world's first cloned dog - snuppy the afghan hound - in 2005.

"they are perfectly the same as their daddy. i am in heaven here. i am a happy person," ms mckinney said at a televised press conference, with tears in her eyes.

she said she was considering training some of the puppies to help the handicapped or elderly after they are delivered to her in the us in september.

it is not the first time that scientists have cloned a dog, but the process is notoriously difficult and the korean team say this is the first commercial success, says the bbc's john sudworth in seoul.

the company which arranged the cloning, rnl bio, says it is now open for future bookings.

as the technology improves, the price is expected to drop.

chief executive ra jeong-chan told afp news agency that rnl bio could clone up to 300 dogs next year for wealthy pet lovers.

he added: "for my next project, i will consider cloning camels for rich people in the middle east."

allentown, pa. — a pottsville, pa., man convinced a 15-year-old girl he was part werewolf and part vampire before sexually assaulting her, police say.

kristian allen carl, 19, also believed he was a supernatural mixed breed, police say.

"he convinced himself he was a hybrid — a combination werewolf and vampire," pottsville police sgt. james joos said. "he had convinced the girl he was, too."

to prove to police he was indeed a genuine vampire/werewolf, carl "showed me his canine teeth," joos said. "i let him know that all mammals, including humans, have canine teeth."

joos said carl also told police he had a "guardian dragon that protected him from evildoers."

carl was charged with statutory sexual assault after admitting he had sexual intercourse with the girl, who told police he was her boyfriend, on nov. 14, 2007, according to an affidavit joos filed.

carl knew the girl's age and was aware he could "get in trouble" for having sex with a girl under age 16, joos wrote. carl told police he had met the girl the previous night and the two went to a friend's apartment to spend the night.

carl remains free on $25,000 unsecured bail, joos said.

"he's being held culpable for his actions," joos said.

stephen chang, a securities trader, said in court papers filed friday that he was at the hot lap dance club near madison square garden and was getting a paid lap dance when the accident occurred early nov. 2, 2007.

according to the lawsuit, as the dancer swung around, the heel of her shoe hit him in the eye, causing him "serious injuries."

a man who identified himself as the manager of the hot lap dance club said he was unaware of the accident or the state supreme court lawsuit. the club's lawyer, stephen ateshoglou, did not immediately return a call.

on its web site, the club describes itself as the "playboy mansion of manhattan party lofts." the site says admission is $50 plus a one-time club membership fee of $10 for newcomers. lap dances cost around $40, plus admission, according to the web site.

that is exactly what the vero beach museum of art in vero beach, florida, has been accused of with an exhibit it has used to draw attention to its 20 year anniversary. the museum has been displaying elegant bronze sculptures they claim are by the artists edgar degas and alberto giacometti. the small statues have been a huge attraction point for visitors of the museum.

however gary arseneau, a florida art analyst, who has done exhaustive research on degas, rodin and other artists, says otherwise. the pieces are “fake as a 3$ bill” according to the researcher.

he points out that the degas pieces in particular are fake, due to the fact that mr. degas never used bronze as a medium. "degas never approved the pieces, never saw them, never signed them, never touched them," arseneau said. "if he is creating art while he's dead, i am eager to see what he creates next."

the officials in question quickly shot back. the director of the museum, lucinda h. gedeon, stated earlier this week, “the practice of posthumously reproducing artists' works in foundries was commonplace in the late 19th and early 20th centuries and accepted by art historians and experts.”

"there is no issue of fakes, no issue of forgery, no issue of defrauding anybody," the museums director said, "are they posthumous? yes they are.”

the previous statement makes no sense. as mr. arseneau said before, it is not very easy for an artist to create works after they have already died. hell, i would go as far as to say it is damn near impossible.

frankly, the rhetoric this museum director is using is an affront to the entire community they have duped. she is exactly what is wrong with this world. instead of admitting to what the man who knows more than her said is true, she has tried to put a play on words to get out of the hot seat.

if it is not degas, then tell the people it is not. simple. stop wasting our time and insulting our intelligence.

rights groups say the case demonstrates another worrying attempt to paint a more benevolent picture of stalin, under whose rule millions perished.

leonid zhura, a convinced stalinist who is representing mr dzhugashvili in court, said that the article - based on declassified kremlin documents - damaged stalin's reputation.

he said: "half a century of lies have been poured over stalin's reputation and he cannot defend himself from the grave so this case is essential to put the record straight.

"we want to rehabilitate stalin. he turned populations into peoples, he presided over a golden era in literature and the arts, he was a real leader."


a phrase in the article saying stalin and the secret police committed grave crimes against their own people caused particular offence, mr zhura said.

stalin's reputation remains a source of controversy. his supporters point out that he defeated nazism - after being double-crossed by hitler with whom he had made a secret deal to carve up poland - as well as making the soviet union a superpower.

words of praise for the georgian-born bolshevik were unveiled last week on the marbled halls of a central moscow metro station. last year he was voted the third greatest russian in a national tv poll.

"we hear much more now about how much of an effective manager stalin was, much more than in the 1990s, and much less about the repression."

nikita petrov, a historian with the memorial human rights group, said: "the authorities are trying to build a bridge to the soviet union over the yeltsin years to idealize stalin.

"they have decided it was too dangerous to delve into the horrors of our history. it is deeply sad. it is the football hooligan's view of history."

"i happen to have been privileged enough to be in on the fact that we've been visited on this planet and the ufo phenomena is real," dr mitchell said.

"it's been well covered up by all our governments for the last 60 years or so, but slowly it's leaked out and some of us have been privileged to have been briefed on some of it.

"i've been in military and intelligence circles, who know that beneath the surface of what has been public knowledge, yes - we have been visited. reading the papers recently, it's been happening quite a bit."

dr mitchell, who has a bachelor of science degree in aeronautical engineering and a doctor of science degree in aeronautics and astronautics claimed roswell was real and similar alien visits continue to be investigated.

he told the astonished kerrang! radio host nick margerrison: "this is really starting to open up. i think we're headed for real disclosure and some serious organisations are moving in that direction."

mr margerrison said: "i thought i'd stumbled on some sort of astronaut humour but he was absolutely serious that aliens are definitely out there and there's no debating it."

officials from nasa, however, were quick to play the comments down.

in a statement, a spokesman said: "nasa does not track ufos. nasa is not involved in any sort of cover up about alien life on this planet or anywhere in the universe.

however, ms fleming said she does not use her powers to influence what suspects say or do.

“i have even started calling my probationer as a joke my padawan (jedi apprentice),” she said, “although i am not sure he likes that.”

according to britain's office for national statistics, a total of 390,000 people in england and wales listed their religion as jedi in the most recent census in 2001.

scotland has a reported 14,000 followers.

but it noted that this may have been largely due to an internet campaign launched in the run-up to the census. jedi followers are grouped under atheist.

the fond du lac man said he hit the 23,000 milestone last month, continuing a culinary obsession that began may 17, 1972, and is fed by his obsessive-compulsive disorder.

“i enjoy them every day,” said gorske, 54. “i need two to fill me up.”

gorske has kept every burger receipt in a box. he says he was always fascinated with numbers, and watching mcdonald’s track its number of customers motivated him to track his own consumption.

despite a diet some would call unhealthy, gorske says he keeps himself in good shape. he says he’s 6-foot-2 and weighs 185 pounds, and walks as many as 10 miles a day.

he used to order fries every day in the 1980s but began to cut back in the ’90s, now eating them about once a month. he eats two big macs and two parfaits a day. gorske has written a book about his experience.

“sometimes people call me a freak but it doesn’t bother me. i just say respect people as they are,” he told the associated press. “i just want to make sure people understand i’m not going to change.”

he can instantly recall the eight days in which he failed to satisfy his craving. one was in 1988, the day his mother died, to respect a request she made.

“i made a promise to her and i always keep my promises,” he said. “i also promised her i wouldn’t cut my hair and in 20 years i haven’t.”

he twice failed to attack a big mac because of his job. a correctional-institution employee, he said a number of work emergencies kept him on the clock past midnight so he recorded those days as missed days.

three other times he was traveling and couldn’t find a mcdonald’s. he also went big mac-less on thanksgiving day 2000, and during a 1982 snowstorm that prevented the local mcdonald’s franchise from opening.

“that’s when i started a habit where i kept them in the freezer,” he said. he keeps one or two burgers on hand but increases his inventory to four to five during the winter.

chris baker and langdon perry of ktlk in minneapolis made the remarks during baker's conservative radio show on wednesday. after johnson condemned the statements, the station said it regretted "some offhand remarks" by the pair.

"we can't have people out here making false statements and putting out bad information, because this battle is too big when it comes to hiv and aids," johnson told the associated press in a telephone interview.

"i poured my life into it and a lot of other people have poured their life into it, into getting out the right information so people can protect themselves and know what hiv and aids is all about."

johnson called the remarks "so stupid," and said he hadn't heard from the station. he also wants the hosts to keep their jobs.

"i would rather they educate their audience," he said.

according to a partial transcript and audio clip posted on a media watchdog site, mediamatters.org, the remarks came after a caller asserted that health care isn't a basic right. perry responded by asking about treatable diseases that a person can live with for a long time ``if you just get some basic drugs.''

baker responded, "like magic johnson?"

perry replied, "like magic with his faked aids. magic faked aids."

baker said, "you think magic faked aids for sympathy?"

perry replied, "i'm convinced that magic faked aids."

"me too," baker said.

johnson was diagnosed with hiv in 1991 and then retired from the nba at 32.

ktlk's statement said it recognized the seriousness of aids and the ``great work'' johnson has done to call attention to the disease.

"we regret that some offhand remarks by commentators on ktlk did not reflect that," the statement said. "to better inform our listeners and employees, ktlk will be airing hiv/aids awareness public service announcements, and will be reaching out to mr. johnson to get his thoughts on education efforts."

program director steve versnick said the station wouldn't comment beyond the statement.
