home repair giant home depot is getting hammered by the public over a dispute with a customer.

the customer is a handyman from lawrence. on saturday, he was banished from all home depot stores, apparently over a pencil. now, the store is releasing a statement to apologize for the incident.

the used pencil wasn't even for sale. it was out at a register when michael panorelli borrowed it and put it in his pocket. home depot barred panorelli from all its stores.

it was a 41-cent carpenter's pencil, but the small piece of wood is causing the methuen carpenter some big headaches.

"i was in the process of picking out the lumber put pencil in my pocket," said panorelli. "i forgot the pencil in my pocket and walked out the door."

panorelli says he was buying $117 worth of wood at the methuen home depot thursday when his friend handed him a used store pencil to mark the wood. but when he forgot to return it, security came running.

"big commotion for one stupid pencil -- a used pencil," said george salas, panorelli's friend.

salas was with panorelli when the incident occurred and couldn't believe what happened next.

"this (the letter from home depot) basically says i have to stay out for a year," said panorelli.

home depot confirms panorelli was handed a letter ordering him to stay away from all home depot's for one year punishment for removing goods without paying.

"they told me the pencil was worth money to the store and i was stealing it and i'm barred from the store because of that pencil," said panorelli.

whatever the ban, panorelli says his home depot days are over for good.

customers cbs4 spoke with say they don't blame him.

"i don't think it's right at all," said one customer. "it's just a pencil. come on now."

cbs4 contacted home depot, which released this statement:

"the home depot contacted mr. panorelli, however we have been unable to speak with him directly. we apologize for any inconvenience this matter has caused him. we will not be pursuing any claims against mr. panorelli for this incident. we welcome mr. panorelli back as a customer in our stores at any time."

minneapolis — organizers of the twin cities marathon said they won't disqualify an 81-year-old runner who won his age group after using a borrowed catheter.

jerry johncock of shelbyville, mich., was sidelined at an aid station about 21 miles into sunday's race because a blood clot prevented him from urinating. the aid station had no catheter, but a spectator stepped forward to offer johncock a catheter he had in his car.

aides helped insert the catheter and johncock went on to finish in a little over 5 hours 22 minutes.

race officials considered disqualifying johncock because of a rule against improper assistance. but executive director virginia brophy achman said they decided johncock didn't break the rule.

she called johncock "a great role model and example of what you can do as a runner."

johncock's wife, dorlene, said her husband was cheered by the ruling. she said he found the whole situation a little humorous.

tokyo (afp) - a nine-year-old japanese boy drove a car alone for three kilometres (two miles) to see his grandmother, saying he was confident at the wheel after playing video games, police said friday.

"i learned from playing video games at arcades and watching my father drive," the boy said, as quoted by a police spokesman in central japan.

he took his family's car from his house in the city of ogaki earlier this week, and headed for his grandmother's home, 15 kilometres (nine miles) away.

as the boy was driving, police received a call from a passer-by who said he had seen an vehicle that appeared to have no driver moving down the street.

police found the car in the parking lot of a convenience store, where the boy was asking a store clerk for directions.

the car was nicely backed into the parking space, according to the police spokesman.

"i am sorry, i just wanted to go to my grandmother's house," the boy was quoted as saying when a police officer found him.

the boy was able to take the car as it had been parked outside of his house with the key left in the ignition.

the boy's parents did not notice his absence as the incident took place early on monday, a public holiday.

"the boy is interested in driving because of video games. he drove the car out of his adventurous mind," the spokesman said, adding the police told his parents to keep a closer eye on him.
