starbucks sued for $114m over recalled employee coupon

starbucks was sued friday for $114 million over its recall last week of a coupon that entitled the holder to a free large iced drink.

peter sullivan, a lawyer who sued on behalf of a 23-year-old starbucks regular who felt "betrayed" when her coupon was not honored, accused the seattle-based company of fraud. he said he will request class-action status to include the "thousands who were misled" by the offer.

riaa sues dead people

yes, our dear friends of the riaa are going after deceased people who, according to them, still download music illegally.

every now and then they even sue grannies who do not own a computer, let alone know how to use one.

but this time, they have reached a new low. they have sued a woman dead since december 2004.

although the woman in question, gertrude watson, has been dead for about 1.5 years, and her daughter has even send them the death certificate, the riaa persisted, saying she had downloaded over 700 music files, under the name of “smittenedkitten”.

the riaa has now dropped the case, but is pursuing other cases, pressuring those accused of pirating to settle the case out of court.

several people now being sued do not even own a computer. however, the riaa does not seem fazed by this, and is continuing legal action against about 235 defendants.

although their tactics of “proving” that people are involved in file sharing are certainly not flawless, the riaa is convinced they are on the right track. “do the crime and you will pay the fine or do the time,” the riaa says on their website.

undoubtedly, they hope that most people sued will settle out of court.

doctor sues over sex charges

a u.s. doctor has sued a seattle-area newspaper for defamation after it reported he posed as his twin, a gynecologist, to have sex with his brother's patients.

dennis momah said the king county journal defamed him in 2003 when it published an article that said: "two twin brothers were taking turns having sex with patients on a regular basis without the patients' knowledge that they were two different people."

momah, who filed the lawsuit in king county superior court this week, also sued harish bharti, an attorney quoted in the paper who represents six female patients of charles momah, dennis momah's twin and a gynecologist.

charles momah is being sued by some of his former patients, who say that he switched places with dennis, giving him access to his gynecological patients.

in february, six patients said in a lawsuit that they were sometimes deceived into being seen, examined, operated on and sexually fondled by dennis momah, a general practitioner who is not certified in obstetrics and gynecology.

charles momah, who had medical practices in two suburbs south of seattle, has pleaded not guilty to criminal charges of rape, indecent liberties and insurance fraud. that trial is scheduled for october 4.

dennis momah, who has not been charged with any crime, said in his lawsuit that the article was "published negligently and with reckless disregard for the truth."

barbara morgan, executive editor of the king county journal, said the newspaper had not been served and did not know the details of momah's lawsuit.

dennis momah's lawyer, timothy ford, said the media coverage had ruined his nigeria-born client's career.

"right now he's looking for work," ford said.

bharti was not immediately available for comment, and phones to charles momah's practices were disconnected.

stripper sues high school teacher for lap dance

nineteen-year-old stripper elaine ivanowski is suing quabbin regional high school after she gave a lap dance to one of her high school teachers and got into a romantic relationship with another.

ivanowski's lawyer richard j. rafferty says that she should have received counselling once it was revealed that she was romantically involved with 36-year-old teacher john monfredo jr.

ivanowski says that instead of getting the help she needed, a teacher she trusted with her secret asked her on date, while another teacher visited the strip club where she worked.

monfredo told a local newspaper that he really was in love with his former student, but did not know whether others at the school were aware of the affair.

rafferty accuses school officials of allowing ivanowski to stay in a relationship she should have been protected from. he goes on to say that monfredo should have been removed from the school.

according to rafferty, ivanowski was under such duress that she was unable to take exams, and she was banned from attending graduation ceremonies.

woman sues zoo over splashing dolphins

chicago (reuters) - a woman is suing a chicago-area zoo for a 2008 fall near a dolphin exhibit, accusing zookeepers of encouraging the mammals to splash water and then failing to protect spectators from wet surfaces, local media reported on thursday.

in her suit filed earlier this week, allecyn edwards said she was injured while walking near an exhibit at brookfield zoo, where a group of atlantic bottlenose dolphins were performing, media said.

officials "recklessly and willfully trained and encouraged the dolphins to throw water at the spectators in the stands, making the floor wet and slippery," but failed to post warning signs or lay down protective mats or strips, the suit said, according to the reports.

edwards is demanding more than $50,000 for lost wages, medical expenses and emotional trauma from the chicago zoological society and the forest preserve district of cook county, which operate the zoo in chicago's southwest suburbs.

doctor sued for using sex as treatment

an oregon woman is suing her doctor for treating her back pain with sexual intercourse, according to yahoo! news.

a $4 million lawsuit was filed against randall smith, who billed oregon health plan $5000 for 45 minute sessions with the woman in which he administered "treatment" in the form of sexual intercourse.

smith, who convinced the woman that having sex with him would "help alleviate her lower back and lower extremity pain", was stripped of his medical license last year and sent to jail for sixty days following the incident.

the lawsuit, filed in multnomah county court this week, cited intentional and negligent infliction of emotional distress. smith pleaded guilty to submitting false health care claims but was adamant that the sex with his patient was consensual.

hairdresser sued for styling error

a japanese hair salon was ordered to pay 240,000 yen in compensation this week after a customer sued the hairdresser for cutting her hair too short and dying it the wrong color.

a tokyo court agreed with the 27-year-old cabaret club hostess's claim that the unflattering hairstyle had affected her ability to do her job, the english language daily yomiuri newspaper said thursday.

"hairstyles are a major influence on appearance," the paper quoted judge yuki mizuno as saying in the ruling. "a hairstyle is a selling point for a cabaret club hostess and there was a period when her self-confidence was affected when she waited on customers."

the woman had claimed 6 million yen in compensation.
