clifton park, n.y. – a diner at a t.g.i. friday's in upstate new york says he got a little something extra with his broccoli — a severed snake head.

jack pendleton says he was at the restaurant in clifton park on sunday when he spotted something gray mixed in with his vegetables. he realized it was a snake head the size of his thumb, with part of the spine still attached.

pendleton says he snapped a photo with his cell phone camera and called the waiter over. he says he has no plans to sue.

a spokeswoman for the carrollton, texas, chain says it's investigating. it wasn't immediately known what kind of snake it was.

pendleton and his girlfriend weren't charged for their meals.

an obstetrician saved his wife and six children from a fire that ravaged their home, delivered a baby while the house was still smoldering and then got cited with building violations.

dr. herman weiss said friday "was just my day."

the 37-year-old awoke around 3 a.m. to the screech of a smoke detector and the sight of flames inching up an outside wall of his long island home. he got his family to safety, then was paged and went to a hospital to deliver an infant around 6 a.m.

the fire brought scrutiny from building inspectors, who cited the weisses with a discrepancy in plumbing plans and living in the house without a certificate of occupancy. weiss said the family had hired a lawyer to get one.

the family has been ordered to tear down the damaged house. weiss said he hopes to rebuild in the same place.

new york (reuters) - four giant waterfalls will be erected in new york for three months this summer in a public art project city officials hope will create $55 million in extra tourism revenue for the big apple.

the waterfalls, including one that will fall from the famed brooklyn bridge, are the brainchild of danish artist olafur eliasson. installation will cost $15 million, funded by private donations to new york's public art fund.

"it's about seeing water in a different way," eliasson told a news conference on wednesday, unveiling plans for the waterfalls, which will range in height from 90 to 120 feet -- around the same as the statue of liberty from head to toe.

three of the waterfalls will cascade into the east river and new york harbor from free-standing scaffolding towers that eliasson said were part of his artistic vision, mirroring the scaffolding towers that sprout up throughout new york. the falls will be in place from mid-july to mid-october.

city officials are hoping to emulate the success of christo and jeanne-claude's project, "the gates," which drew around 1.5 million visitors to the city in february 2005 to view about 7,500 saffron panels draped through central park.

increased hotel, restaurant and other business revenues linked to the waterfalls should bring an additional $55 million to the city's economy, deputy mayor patricia harris said.

the circle line downtown boat company will offer free and discounted trips to give visitors a closer look at the waterfalls.

but eliasson said the tour boats would not be able to get as close to the water as tourist boats do to new york state's most famous waterfall, niagara falls, on the canadian border.

"it's quite a lot of water, it would not be good to go under," eliasson said. the scaffolding will have a floating barrier at the bottom to stop small boats going underneath and a "shark cage" under the water to stop fish being sucked into the pumps that will take the water to the top.

the pumps will be powered by renewable energy sources and the falls will be lit only by low-level lighting at night that eliasson said would be "not las vegas-style."

eliasson, who was born in copenhagen in 1967, is best known for his 2003 installation "the weather project" at the tate modern in london, a giant sun made of mirrors, lamps and mist that drew over 2 million viewers.

new york - a hospital did nothing wrong when it tried to examine the rectum of a construction worker who had been hit on the head by a falling wooden beam, a jury found monday.

after deliberating for about an hour, a state supreme court jury awarded nothing to brian persaud, who sued newyork-presbyterian hospital for unspecified damages. the panel found the hospital and its emergency room medical staff were not liable.

persaud's lawyers, gerard marrone and gary defilippo, said he might appeal.

"we're very disappointed," marrone said after the two-week trial. "it's a miscarriage of justice."

the hospital's lawyer, jeffrey lawton, declined comment.

marrone said persaud, 38, was injured while working at a construction site in midtown manhattan on may 20, 2003. persaud received eight stitches for a cut over his eyebrow at the hospital, but denied emergency room staffers' request to examine his rectum, the lawyer said. he said doctors told persaud the exam could help determine whether the accident caused spinal damage.

when persaud resisted, staffers held him down while he begged, "please don't do that," marrone said. persaud hit a doctor while flailing around, so the staffers gave him a powerful sedative and performed the rectal exam, he said.

hospital witnesses testified at trial that the exam was never completed, but marrone said that when persaud woke up he was handcuffed to a bed and had an oxygen tube down his throat and lubricant in his rectum.

"he resisted because he didn't know what they were doing," defilippo said. "once he said he didn't want the rectal exam, everything should have stopped."

defilippo said he believes the rectal exam was done as retaliation because his panicked client hit the doctor.

a judge dismissed a misdemeanor assault charge that was filed against persaud because he hit the doctor.

defilippo said his client is unemployed and has been unable to hold a job since the accident.

a new york policeman who was caught on video apparently body slamming a woman to a tile floor has been acquitted of civil rights violations. jurors in federal court in white plains found 39-year-old yonkers police officer wayne simoes (sim-oze) not guilty wednesday afternoon. the video, from a restaurant surveillance camera, seemed to show the officer lifting 44-year-old irma marquez by her waist and throwing her face-first to the floor. she was knocked unconscious and her jaw was broken.

a missile fell off a truck and onto a new york highway friday, but the weapon did not have a warhead and posed no danger, police said.

wcbs radio reported it was a tomahawk cruise missile. police and fire department officials could not confirm that.

the cargo came loose when the truck carrying it collided with another truck on a motorway in the bronx.

"it was a military-type missile but it was inert. there was no danger and no one was harmed," a police spokesman said.

an enormous blaze, the biggest since the attacks on the wtc, has turned a complex of seven historic warehouses on the east river waterfront in brooklyn to rubble.

the fire started yesterday morning. as hundreds of firefighters battled the flames unsuccessfully, the smoke could be seen for miles.

the complex was part of the historic waterfront area and was planned to be redeveloped as high-rise housing.

although the complex was officially unoccupied, it is not known if there were squatters living there at the time. firemen have reported seeing bales of cloth.

the fire is being investigated as suspicious.
